📋 Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and Agility LLC ("we," "our," or "us"), governing your use of the WikiRacer website at wikiracegame.com and the WikiRacer mobile application (the "WikiRacer app"), available on Google Play and the App Store (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

🎮 Description of Service

WikiRacer is a free-to-play game in which players navigate from one Wikipedia article to another using only internal hyperlinks. The Service includes:

• Solo mode with customizable difficulty settings
• Daily challenges with streak tracking
• Real-time multiplayer racing
• Statistics tracking and achievement system
• Leaderboards and social features

👤 User Accounts

You may use certain features of the Service without creating an account. However, multiplayer and cloud sync features may require authentication through Google Sign-In or other supported providers.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

✅ Acceptable Use

When using the Service, you agree not to:

• Use automated scripts, bots, or cheating tools to gain an unfair advantage
• Exploit bugs or glitches rather than reporting them
• Harass, abuse, or threaten other players in multiplayer sessions
• Impersonate another user or entity
• Use the Service for any illegal or unauthorized purpose
• Attempt to interfere with, compromise, or disrupt the Service or its servers
• Circumvent or disable any security features of the Service
• Scrape, data mine, or harvest user data from the Service

💰 In-App Purchases & Advertising

The WikiRacer app is free to play and is supported by advertisements served through Google AdMob. The app may also contain in-app purchases.

• All in-app purchases are processed through the respective platform (Google Play or App Store) and are subject to their terms and refund policies.
• Purchases are final and non-refundable unless required by applicable law or the platform's refund policy.
• We reserve the right to modify pricing, availability, and content of in-app purchases at any time.

📚 Wikipedia Content

WikiRacer fetches and displays content from Wikipedia via the MediaWiki API. Wikipedia content is available under the Creative Commons Attribution-ShareAlike 4.0 License.

• We do not own, control, or endorse the content of Wikipedia articles
• Wikipedia content may contain inaccuracies or be subject to change without notice
• We are not responsible for the accuracy, completeness, or reliability of Wikipedia content

🏆 Leaderboards & Fair Play

We strive to maintain a fair and competitive environment. We reserve the right to:

• Remove or adjust scores that we believe were obtained through cheating or exploitation
• Modify or reset leaderboards at our discretion
• Ban users who engage in unsportsmanlike conduct

🧠 Intellectual Property

The Service, including its original content (excluding Wikipedia content), features, functionality, design, logos, and branding are owned by Agility LLC and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute any part of the Service without our express written permission
• Use our trademarks, logos, or branding without authorization
• Reverse engineer, decompile, or disassemble any portion of the Service

⚠️ Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any content

🛡️ Limitation of Liability

To the maximum extent permitted by applicable law, Agility LLC and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory.

🔄 Indemnification

You agree to defend, indemnify, and hold harmless Agility LLC and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or transmit through the Service

🏛️ Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

🚫 Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data
• Provisions that by their nature should survive termination shall remain in effect

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
